Terms and Conditions of Use — Nombrelia

These terms govern the use of the “Nombrelia” mobile app for iOS and Android (identifier com.opharana.nombrelia) and of the pages of this website that open from its links: the pair invitation, the family vote and the recommendation (hereinafter, together, “Nombrelia”), owned by OPHARANA LLC, with its registered address at 99 Wall Street, Suite 1432, 10005, New York, United States, and email hello@opharana.com.

By downloading, installing or using Nombrelia, you accept these terms. If you do not agree with them, do not use it.

1. What Nombrelia is

Nombrelia is a tool for choosing a baby’s name as a couple. Two people form a pair with a link or a code; each of them says yes or no to names in daily rounds; the names they both say yes to go on a shared list and, if they wish, the family votes on their finalists from the browser. Each person’s votes are secret: the other person only sees the matches.

Nombrelia suggests names and provides information about them, but the choice is yours alone.

2. Minimum age

Nombrelia is intended for people aged 14 and over. By using it, you declare that you are at least that age.

3. Your anonymous account

Nombrelia does not require sign-up. When you open the app, or the link to an invitation or a vote in your browser, an anonymous account is created that is tied to that installation or that browser. If you delete the app or your browser data, or switch phones, you lose access to your pair, your votes and your shared list, and we cannot recover them, because we do not know who you are. You can delete your data at any time from Settings → “Delete my data” (details in the Privacy Policy).

4. The pair, content and conduct

Each pair is made up of two people, and each person can only be in one pair at a time. The filters and the baby’s last name are shared: either of the two can change them and they apply to both. Either of them can leave the pair in Settings; when they do, their votes and the shared list are deleted.

Only share the pair link or code with your partner: with it, anyone can see who created the pair and, while there is room, join it. And only share the vote link with the people you want to vote: with it, anyone can see your names, the baby’s last name and the finalists, and vote.

You are responsible for what you write in Nombrelia: your name in the pair, the baby’s last name and, in the vote, what you enter in “Who are you?”. By using Nombrelia, you agree not to:

• Write content that is offensive, unlawful or infringes the rights of others, or personal data of third parties.
• Impersonate another person or join pairs or votes you have not been invited to.
• Modify the app, reverse engineer it, use external programs that interact with it on your behalf or attempt to access other users’ data.
• Create accounts, pairs or votes in bulk or for the purpose of obtaining rewards fraudulently.
• Interfere with the services Nombrelia depends on or use it for unlawful purposes or purposes contrary to good faith or public order.

We may delete content and pairs that breach these terms.

5. Free use and Nombrelia Plus

Without paying, Nombrelia gives you two rounds of names a day, up to three more by watching a video ad, and the girl or boy, country and last name filters. Nombrelia Plus removes the ads and adds unlimited rounds, the origin, length and first letter filters and the family vote. Plus works for both members of the pair as long as one of them has it and you remain in the same pair. It is offered in two ways, with the price in your currency shown before you buy:

• Monthly subscription with automatic renewal. The amount is charged to your Apple or Google account when you confirm the purchase and then at the start of each month, unless you cancel the subscription at least 24 hours before the end of the current period.
• One-time lifetime payment. You pay only once, it does not renew, and it keeps Plus on your store account for as long as Nombrelia remains available in the stores.

How to cancel the subscription:

• iPhone: Settings → your name → Subscriptions → Nombrelia → Cancel Subscription.
• Android: Google Play → your profile picture → Payments & subscriptions → Subscriptions → Nombrelia → Cancel subscription.

When you cancel, you keep Plus until the end of the period you have already paid for and you are not charged again. Uninstalling the app, leaving the pair or deleting your data does not cancel the subscription.

• Billing is handled entirely by Apple (App Store) or Google (Google Play), depending on your platform, under their own terms. We do not see or store your card or billing details.
• The digital content is delivered immediately after purchase. By agreeing to immediate delivery, you may lose the right of withdrawal that consumer law provides for digital content.
• Refunds and payment claims are handled through Apple or Google, not through us. If you have a problem with a charge, contact the support team of the relevant store.
• The purchase is linked to your store account. You can recover it with “Restore purchases” in the app, using the same Apple ID or the same Google account.
• We may change the price of Nombrelia Plus. If the subscription price changes, Apple or Google will notify you before it applies, and you will be able to cancel it.

6. A month of Plus for recommending Nombrelia

You can recommend Nombrelia to another couple with your recommendation link (nombrelia.com/r/ followed by your recommendation code, which is different from the code for joining your pair) or with that code. If someone in the new pair uses your code when creating it, or later in Plus → “I have a code from another couple”, then with that pair’s next match, once it is complete, you and that person each earn a month (30 days) of Nombrelia Plus. Since Plus works for both members of a pair, both couples get to enjoy it.

Each person can only earn a reward once for using a code, and each person can earn a maximum of 12 months by recommending the app. If the person making the recommendation has already reached that maximum, the recommendation gives no reward to either of them. You cannot use your own code or your partner’s. The months are added to any you already have and are checked by our server.

Free months have no monetary value, cannot be exchanged for money or transferred and do not affect a paid subscription, which keeps renewing until you cancel it. We may modify or end this promotion at any time, without affecting months already earned, and cancel rewards obtained fraudulently. We never reward ratings in the stores or posts on social media.

7. Advertising

The app shows Google AdMob ads and in-house ads from TuIAgencia, the owner’s agency. In the European Economic Area, the United Kingdom and Switzerland, you are asked for your consent before any Google ad is loaded. While Nombrelia Plus is active, no advertising is shown. The pages of this website have no ads. The details are in the Privacy Policy.

8. Nombrelia’s content

• Meanings and origins: we write them ourselves based on the most widely accepted etymology. They are a guide only, and many names have more than one explanation.
• Statistics: they come from the official data published by each country, with its license and attribution (details in Data sources). They may contain errors or rounding, cover a single year, a region or a city, and are not always comparable between countries.
• Before registering the name, check the civil registry rules in your country: some countries restrict which names can be given.

9. Service availability

Nombrelia depends on third-party servers and services and needs an internet connection to vote and see your matches. We do not guarantee that it will work without interruptions or errors. We may modify, update or remove features and, if necessary, discontinue Nombrelia; if it were to be shut down permanently, we would announce it with reasonable notice in the app or on this website.

10. Intellectual property and license to use

Nombrelia, its code, its texts (including the meanings of the names), its design and its graphic elements are owned by OPHARANA LLC or by third parties who have authorized their use. We grant you a personal, limited, non-exclusive, revocable and non-transferable license to use Nombrelia for private, non-commercial purposes. You may not copy, distribute or modify it or create derivative works from it.

The brand and the names use the Fraunces typeface, by The Fraunces Project Authors, under the SIL Open Font License 1.1. The name statistics belong to the agencies cited in Data sources and are used under their licenses. The app also includes third-party software under its respective open-source licenses.

11. Limitation of liability

Nombrelia is provided “as is”. To the fullest extent permitted by applicable law, the owner is not liable for indirect damages, loss of profits, loss of data or harm arising from the unavailability of the service, from errors in the app or its content, from your use of it or from what other users write. Nor is it liable for the choice of the name or its registration with the civil registry.

Nothing in these terms excludes or limits liability that cannot be excluded by law, such as liability for willful misconduct, or the rights that consumer law grants to users acting as consumers.

12. Relationship with Apple and Google

These terms are entered into between you and OPHARANA LLC, not with Apple or Google. Apple and Google are not involved in the service and assume no responsibility for the app, its content, its maintenance or its support. In the case of iOS, Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

13. Changes to these terms

We may update these terms to reflect changes to Nombrelia or to applicable law. The version in force will always be the one published on this page, with its update date. If the change is substantial, we will let you know in the app. Continuing to use Nombrelia after publication means you accept the changes.

14. Governing law, jurisdiction and language

These terms are governed by Spanish law. For the resolution of any dispute, and where the applicable consumer law so permits, the parties submit to the courts and tribunals that have jurisdiction under the law. If you are acting as a consumer, you retain the right to bring proceedings before the courts of your place of residence. These terms are published in several languages; in the event of any discrepancy, the Spanish version prevails.
